Terms & Policies
(a) IMAGE includes a photograph, transparency, negative, digital scan, design, artwork, painting, montage drawing, engraving, video, or any other item which may be offered for the purposes of reproduction.
(b) REPRODUCTION includes any form of publication or copying of the whole or part of any image and whether or not altered by printing, photography, slide projection (whether or not to an audience) xerography, artist's reference, artist's illustration, layout or presentation, electronic or mechanical reproduction or storage by any other means.
(c) THE CLIENT is the person or organisation to whom the invoice is addressed.
(d) COVERAGE: the amount of time booked for your photoshoot and the list of inclusions will be supplied prior to booking. By confirming a booking it is understood that The Client has understood and accepts the allocated coverage.
The booking fee determined by The Photographer is required to secure your photo shoot time and date. Payment in full is required on or before the date of the scheduled photoshoot.
COPYRIGHT AND REPRODUCTION OF IMAGES:
The entire copyright of all images is retained by The Photographer representing The Client at all times throughout the world.
Gemma Carr Photography hereby grants the Client to use or reproduce the photographs for the bounds specified within the project only. This applies to images the for which the Client has purchased.
The Client will use these photographs as agreed and understand they may not be copied or reproduced unless written approval is granted by the Photographer.
Any publication or reproduction of images must be accompanied with a credit to The Photographer. Unless otherwise specified, the copyright notice should read © Gemma Carr Photography.The Client grants permission for Gemma Carr Photography to use my/our name/s and photographic likeness in all forms and media for advertising, trade, promotional, photographic award submissions and any other lawful purposes.
THE PHOTOGRAPHY SESSION:
Photography coverage commences at the scheduled start time and ends at the scheduled end time.
Notification of any changes in schedule or location must be made in a timely manner by the Client and receipted by the Photographer.
All additional time beyond the scheduled end time will be billed to the Client.
To avoid disruption to the photographic coverage and to allow the Photographer to fulfil their duty; other photography by at this time is not permitted.
The Client has received, read and understood the Photographer's quote for the project.
Full payment will be required prior to the supply of finished images.
Invoice will be supplied either before or at the completion of the project, payment due with 7 days of invoice date.
The prices quoted will be guaranteed for 30 days.
Once a booking is made, if it is subsequently cancelled, a cancellation fee will be charged to the client according to the following schedule. When a client cancels a booking within two weeks of any confirmed date, a fee of 30% of the booked time rate will be charged. When a client cancels photography within one weeks of any confirmed date, a fee of 50% of the booked time rate will be charged. In addition to this cancellation fee, the client will be charged for any expenses already incurred by The Photographer.
COOLING OFF PEROID:
There is a two working day cooling-off period from the date of booking the photoshoot. This is before the photography is commenced and for any orders placed. Any requests for a refund must me made in writing to email@example.com
This Agreement shall be subject to and constructed according to the law in Victoria, Australia and the parties agree to accept the exclusive direction of Victorian Courts.
No variation of terms and conditions set out herein shall be effective unless agreed in writing by both parties.
